兒童禁用社交平台

 

澳洲工黨這打算把這項法案於今年年底前通過成為法律。屆時，社交平台如Facebook、Instagram、TikTok、Snapchat等，將有負責確保不到法定年齡的人士不能開設或持有帳戶，否則將被視為違法，可能會被處以最高 5000 萬元的罰款。  YouTube預計也被納入法案規限範圍。而匿名網上論壇如4chan、Reddit可能無法受規管，因為不需要用戶註冊帳戶。而即時通訊程式如WhatsApp、網上遊戲、提供「健康和教育支持」的服務平台，則不在此限。

 

預計所有想使用受影響平台的澳洲人都要進行年齡驗證，但目前未知用戶需要提交哪些數據。政府已表示，可能需要收集、使用和披露額外的個人資訊。但當局排除實施強制性的數碼身份證，反對黨也對此設立紅線。

聯邦通訊部長強調，改革是為了保護年輕人，讓家長知道政府是支持他們。「立法將確保將保護（年輕人）的責任交給社交平台，而不是父母或兒童。」相反地，有140名專家發出公開信，指禁令是糾枉過正。澳洲人權委員會也表示，考慮到相關法例有可能嚴重干預兒童和青少年的權利，它對該禁令持「嚴重保留」態度，建議採取責任（duty of care）模式來處理。

 

很佩服澳洲政府的勇氣，嘗試成為全球首個立法禁止兒童使用社交媒體的政府。 現今社交媒體滲透入社會所有階層，但其登出的內容多是失實、八卦、作偽、訛傳的無實際意義訊息，有的更是製造混亂及詐騙錢財的信息，而覧閱羣眾卻是無責任及發噏風地討論，除了浪費時間在閱讀無益的資訊外，兒童更被這類不良訊息引導致錯誤思惟及影響其健康成長的過程。 什麽干預兒童的權利是不正確的，因兒童在現今法例下也被禁買烟酒，目的就是要保障兒童的健康，而非剝奪其人權。禁止兒童使用社交媒體亦如是，旨在保障兒童的身心發展。

 

這法例在執行時也將會困難重重，因兒童可以借用成人(如其父、母、兄、長)的社會媒體帳號流覽社交媒體，而政府亦無從監察。
